1. Introduction & Scope

6. Data Sharing & Disclosure
6.1 ph359 does not sell personal data. Personal data is shared only in the following circumstances and only to the extent necessary for the stated purpose:
- Payment Processors: GCash, Maya/PayMaya, GrabPay, BPI, BDO, Metrobank, 7-Eleven CLiQQ, and other payment partners receive transaction data necessary to process deposits and withdrawals.
- KYC Verification Providers: Identity documents and biometric data collected during KYC are shared with third-party identity verification services engaged by ph359 for this purpose, under data processing agreements that bind those providers to RA 10173 standards.

7. Data Retention Periods

7.2 The following indicative retention periods apply:
- Account and KYC data: Retained for a minimum of five (5) years after account closure, in compliance with RA 9160 (Anti-Money Laundering Act) record-keeping obligations.
- Financial transaction records: Retained for a minimum of five (5) years from the date of each transaction.
- Gameplay data: Retained for a minimum of three (3) years for dispute resolution and regulatory audit purposes.
- Customer support communications: Retained for two (2) years from the date of the last communication in a support thread.
- Marketing consent records: Retained for the duration of the consent and for one (1) year after withdrawal, as evidence of the consent history.
7.3 After the applicable retention period expires, personal data will be securely deleted or anonymised in a manner that prevents re-identification, unless further retention is required by a valid legal obligation.
8. Security Measures
8.1 ph359 implements technical and organisational security measures appropriate to the risk presented by the personal data it processes. These measures include:
- TLS encryption for all data in transit between your device and ph359 servers;
- At-rest encryption for sensitive stored data, including financial account details;
- One-way cryptographic hashing for all stored passwords — ph359 cannot retrieve your password;

8.2 No security system is impenetrable. While ph359 takes all reasonable steps to protect your data, we cannot guarantee absolute security. 9. Your Data Subject Rights

Right to Access

Right to Data Portability

Right to Restriction

10.2 ph359 uses the following types of cookies:

11.2 If ph359 becomes aware that personal data has been collected from a person under the age of 18, that data will be deleted promptly, the associated Account will be permanently closed, and the matter reported to PAGCOR in accordance with regulatory obligations.

12. Cross-Border Data Transfers
12.1 In the course of providing its services, ph359 may engage third-party service providers whose infrastructure or personnel are located outside the Philippines — for example, cloud hosting providers, identity verification services, and game software providers.
12.2 Where personal data is transferred outside the Philippines, ph359 ensures that such transfers comply with the requirements of RA 10173, including by implementing appropriate contractual safeguards with recipient organisations to ensure an equivalent standard of data protection.
12.3 ph359 does not transfer personal data to jurisdictions that lack an adequate legal framework for the protection of personal data without first implementing appropriate contractual protections.
13. Changes to This Policy
13.1 ph359 may update this Privacy Policy from time to time to reflect changes in applicable law, regulatory requirements, or Platform operations. Material changes will be communicated to registered players via the email address on record and/or through a prominent notice on the Platform at least seven (7) days before the amended Policy takes effect.
